Kilifi man gets 50 years in jail for sexually assaulting his nephew

A 45-year-old man from Kilifi County has been sentenced to 50 years in prison after being convicted of repeatedly sexually assaulting his eight-year-old nephew.

Onalo heard that Baya was a notorious predatory paedophile, who lured his nephew to his room for the acts and then bought his silence by giving him Sh10 each time.

She noted that the minor "suffered horrendously, psychologically, emotionally, and physically", and that the prosecution, through Suke Summaru, "discharged its responsibility of proving the case beyond reasonable doubt."

Five witnesses, including the minor, testified in the case, and the court observed that evidence incriminated the accused, rendering him unable to unshackle himself from the crime.

Ahead of sentencing, Summaru urged the court to consider the severity of the assault on the minor and issue a tough punishment for the convict.

The minor, who suffered extensive injuries and trauma, said he was severely abused and threatened with death if he dared reveal the incidents to his parents or siblings.

Baya's fate was sealed when the minor’s father overheard his elder brother talking about the sexual assault.

The minor opened up after the father demanded that he and his brother shed more light on what they were talking about.

The man alerted his wife, the children’s mother, who reported that the victim had been having difficulties walking and answering the call of nature.

After word spread in the village, members of the public arrested Baya and took him to Gongoni Police Station, where he was arrested and charged with incest.

He was investigated and convicted after it was proven that he committed the crime on various dates in November 2022 at Pumwani Village in Magarini Sub-county.
